Terms of Service

The terms that govern access to and use of EasyKount products.

01Agreement and eligibility

These Terms of Service ("Terms") govern access to and use of products provided by EasyKount Technologies Pvt. Ltd. ("EasyKount", "we", "us", or "our"). By accessing a Service you agree to these Terms. If you use a Service for an organisation, you confirm that you are authorised to accept these Terms on its behalf.

If you do not agree to these Terms, do not access or use the Service.

02Where a signed agreement governs instead

Most EasyKount products are supplied to an organisation under a written subscription or order form. Where such an agreement exists it controls, and these Terms apply only so far as they do not conflict with it. Nothing on this page varies a signed agreement.

These Terms govern the EasyKount website directly, and they govern products a person installs without an organisation in between.

03The Service

Each EasyKount product is described on its own page on this website. We may add, change, suspend or discontinue features, provided we use reasonable efforts to avoid unnecessary disruption and to preserve applicable organisation data.

A Service may depend on third-party services, networks and devices. We are not responsible for outages or failures outside our reasonable control, but we will work to restore the Service when practicable.

04Accounts and authorised use

Users must provide accurate account information, keep credentials confidential and use only accounts assigned to them. Organisations are responsible for approving users, assigning appropriate roles, reviewing access and promptly disabling accounts that are no longer authorised.

You may use a Service only for lawful purposes. You must not bypass access controls, probe or disrupt the Service, upload malicious code, impersonate another person, infringe rights, or use the Service to violate applicable law or an organisation’s policy.

05Organisation data and privacy

An organisation retains its rights in information and content it submits to a Service. EasyKount may process that information only to provide, secure, support and improve the Service as permitted by the organisation’s agreement and our Privacy Policy. The organisation is responsible for the accuracy, lawful basis, permissions and notices associated with the information it submits.

Our Privacy Policy explains how we handle personal information and forms part of these Terms.

06Financial and educational services

EasyKount is a software provider. Where a Service presents accounts, deposits, loan repayments, fees or academic records, those products and records belong to the organisation that issued them — a financial institution, a school, or another subscribing organisation. EasyKount does not hold deposits, does not originate or underwrite loans, is not a bank or financial institution, and is not an educational institution.

The organisation’s own terms govern the products and records it issues.

07Intellectual property

EasyKount and its licensors own the Service, software, interfaces, documentation, designs, trademarks and other materials we provide, excluding data submitted by an organisation or a user. We grant authorised users a limited, non-exclusive, non-transferable right to use the Service during the applicable subscription or trial period in accordance with these Terms.

You may send suggestions or feedback. You grant EasyKount permission to use that feedback without restriction or compensation, provided it does not identify you or disclose organisation data.

08Trials, fees and suspension

Where EasyKount provides a trial or free access period it is for evaluation and may be subject to feature, usage, duration and data-retention limits stated at sign-up or in the applicable order. Paid subscriptions, renewals, taxes, refunds and payment terms are governed by the applicable order or subscription agreement.

We may suspend or limit access if fees are overdue, if use creates a security risk, or if continued access would violate these Terms or applicable law. We will use reasonable efforts to give notice and an opportunity to resolve the issue where appropriate.

09Disclaimers

The Service is provided on an "as available" and "as is" basis to the extent permitted by law. EasyKount does not provide legal, financial, medical, educational or other professional advice through the Service. Organisations and users must review records and reports before relying on them and remain responsible for their decisions, compliance obligations and communications.

10Limitation of liability

To the maximum extent permitted by applicable law, EasyKount will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, goodwill or data arising from use of the Service. EasyKount’s total liability for claims relating to a Service will not exceed the fees paid or payable for that Service during the twelve months before the event giving rise to the claim, unless the applicable written agreement states otherwise.

11Termination and data export

An organisation or user may stop using a Service in accordance with the applicable subscription or agreement. EasyKount may terminate or suspend access for material breach, legal or security risk, or where the Service is discontinued. On termination, authorised organisations may request export or deletion of their data in accordance with the applicable agreement and our retention obligations.

12Governing law and contact

Unless a written agreement states otherwise, these Terms are governed by the laws of India, and disputes will be subject to the courts having jurisdiction over EasyKount Technologies Pvt. Ltd., subject to any mandatory rights under applicable law.
